Lesbian U.S. Employee Set Back In Benefits Fight

A U.S. judge on Wednesday dealt a setback to a lesbian federal employee’s bid to obtain health insurance for her same-sex spouse, according to a court ruling.

U.S. District Judge Jeffrey White dismissed a lawsuit on procedural grounds brought by Karen Golinski, and denied her request for an injunction.

He left the door open for Golinski to directly challenge the constitutionality of the benefits denial.

The administration of President Barack Obama has opposed Golinski’s lawsuit, even after the Justice Department announced last month that a federal statute defining marriage as a union between one man and one woman — known as the Defense of Marriage Act — was unconstitutional.
